1. The contract between us
1.1 CardStar is a personalised sports card service operated by Artily Group Ltd and its operating companies and affiliates, including Prodigi (UK) Ltd, Prodigi Global Ltd, Prodigi BV and Prodigi USA Inc (“the Company”, “we” or “us”), as applicable to your order. Prodigi (UK) Ltd is registered in the United Kingdom under company number 10844939, with its address at Unit 20, Caker Stream Road, Alton, Hampshire, GU34 2QA, UK.
1.2 These terms govern your use of this site and all orders you place for cards (“Products”). By using the site or placing an order you agree to them, together with our Privacy & cookie policy. If you do not agree, please do not use the site.
1.3 We may change these terms by posting the changes on this page. The terms that apply to an order are those in force when you placed it.
2. Orders
2.1 An order is an offer by you to buy the Products. We are not obliged to accept it, whether or not we have acknowledged it.
2.2 We will email you to acknowledge your order; that is not acceptance. Once payment has been received we will confirm that your order has been accepted, and that confirmation creates a legally binding contract between us for that order.
2.3 If there is a problem with your order, our customer service team will contact you.
3. Products
3.1 CardStar cards are custom-printed products, made to your specification from the text, images and design choices you provide. Sizes range from A5 to A0.
3.2 We make every reasonable effort to show the Products accurately, but there may be slight variations in colour and appearance from how they look on screen, and sizes and material may vary slightly from one print to the next.
4. Price and payment
4.1 The price is the price shown at checkout when your order is placed. Taxes and delivery charges are shown at checkout.
4.2 Payment is taken at checkout through Shopify. By paying you confirm that your use of the payment method is authorised and that the information you give is true and accurate. Payments may be subject to validation checks or authorisation by your payment provider. If you pay with a card in a currency other than the one charged, your provider sets the conversion rate.
4.3 We try to make sure all prices are correct. If a Product was listed at an incorrect price, we will tell you the correct price as soon as possible and let you confirm your order at that price or cancel it for a full refund.
5. Your content
5.1 You are responsible for the content you submit (names, photos, text). You confirm that you have the right to use any photos you upload, that your content does not infringe anyone else’s rights, and that it is not offensive, defamatory or illegal. We may refuse any order containing inappropriate content.
5.2 When you upload content, you give us a limited, non-exclusive licence to store, process and use it solely to deliver the service and fulfil your orders. We share it with third parties only where necessary for production by our print facilities, as described in our Privacy & cookie policy.
5.3 You are responsible for checking the spelling, photo position and details on your card before you order. The card you see in the preview is the card we print.
6. Delivery
6.1 We aim to deliver your Products as soon as possible after you order. Timings depend on where you are and on the carrier, and are an estimate rather than a promise. If we cannot deliver within 30 days of your order, we will tell you, and you may cancel the order and receive a refund. We are not liable for damages or penalties for delay in delivery, however caused.
6.2 Please check that the Products delivered match the delivery paperwork and are undamaged, and keep the delivery note and packaging. Tell us at support@cardstar.me within 14 days if anything is missing or damaged.
6.3 Risk in the Products passes to you when they are delivered to the address in your order, and we are not liable for loss or damage after delivery.
6.4 It is your responsibility to follow the laws that apply to the possession and use of the Products where you are.
7. Cancelling and changing an order
7.1 Bespoke orders. Every card is made to your unique specification (“Bespoke Order”). By confirming your order you agree that it cannot be modified once production has begun, and that, because it is made to your specification, it is exempt from the usual right to cancel under UK consumer law once it is in production.
7.2 You may amend or cancel a Bespoke Order before it is submitted for production. After that we may still consider requests to change details such as the delivery address; our customer service team will tell you whether it is possible and any cost. Send requests in writing to support@cardstar.me.
7.3 If we cancel or you cancel in line with this section, we will refund the amount paid to the original payment method.
7.4 We may cancel an order, or part of one, if we cannot fulfil it, if there is a problem with payment, if the content breaches these terms, or if the price was listed incorrectly and you do not confirm the corrected price.
8. Faulty or damaged Products
8.1 Products will be free from material defects and of satisfactory quality.
8.2 If a Product is materially defective or incorrect on delivery, tell us within 14 days of delivery at support@cardstar.me. We will then make good any shortage or non-delivery, or replace any Product that is materially defective or damaged, or, where we cannot, refund the amount you paid for it to your original payment method. We may ask you to return the faulty Product and will reimburse reasonable postage on receipts.
8.3 These remedies are in addition to your statutory rights as a consumer, which nothing in these terms limits.
9. Our liability
9.1 Except where the law does not allow it, we are not liable for indirect, incidental, special or consequential loss or damage arising from your use of the site or the Products, and our liability for a Product is limited to refunding what you paid for it.
9.2 It is your responsibility to make sure the Products are suitable for your purposes and that the details you give in your order are accurate. We are not liable for defects caused by your failure to follow ordering instructions or by misuse or alteration of the Products.
9.3 Nothing in these terms limits your statutory rights, or our liability for death or personal injury caused by our negligence, or for fraud.
10. Intellectual property
10.1 We and the relevant copyright holders keep all rights in the site, the service and the designs, text, images, artwork and other material on it. You may use the Products for your own personal use and not for any business purpose, and may not sell, copy, modify or create derivative works from the site or the designs, or try to interfere with the site.
10.2 You are responsible for how you use the Products you buy. Not affiliated with, or endorsed by, EA Sports or FIFA.
10.3 If you believe material on the site infringes your copyright, email support@cardstar.me with details of the work, where the infringing material is, and your contact details.
11. Acceptable use
11.1 You must not breach or try to breach the security of the site, access data not meant for you, probe or test our systems, or use the site in a way that interrupts, damages or impairs it. Breaches may lead to civil or criminal liability.
11.2 You must not use a false email address or impersonate anyone, and content you send us must be lawful and not malicious, defamatory, obscene or designed to offend.
11.3 We may refuse or end your use of the site if you breach these terms.
12. Events outside our control
We are not liable for any failure or delay in delivering Products, or any damage or defect, caused by something beyond our reasonable control, including strikes and other industrial disputes, breakdown of systems or network access, failure of suppliers or producers, flood, fire, explosion, acts of terrorism or accident.
13. Links to other sites
The site may link to third-party sites. We do not control and are not responsible for their content, products or services.
14. Data protection
Our Privacy & cookie policy explains how we collect, use and share personal data and how to exercise your rights, and forms part of these terms.
15. General
15.1 If any part of these terms is found invalid or unenforceable, the rest remains in force, and the part will apply with whatever change is needed to make it valid.
15.2 These terms, with our current prices, delivery details and Privacy & cookie policy, are the whole agreement between us about the site and the Products. Nothing said by a salesperson changes them.
15.3 Only you and we have rights under the contract; no one else can enforce it under the Contracts (Rights of Third Parties) Act 1999.
15.4 We may give you notices and information electronically. Nothing here creates an agency, partnership or employment between us, and a failure to enforce a right is not a waiver of it.
16. Governing law
The contract between us, and any matter arising from it, is governed by English law and the English courts have exclusive jurisdiction, without affecting any mandatory consumer rights you have in the place you live. A claim against the Company arising from the site or the Products must be brought within one year of arising, to the extent the law allows.
